Brief legal analysis of the legality of Bansko Ski Zone

In order to answer the question how legal are the skiing facilities in Bansko Ski Zone, the experts of the “ForTheNature”
Coalition of NGOs carried out a legal analysis which examines the following:
- Was the ski facility envisaged in the Concession Contract for Bansko Ski Zone and respectively – in the
Management Plan (MP) of Pirin National Park?
- Were the construction regimes of the MP and the conditions in the Environmental Impact Assessments (EIA)
(issued by the Ministry of Environment and Water) abided by?
- Did Bansko Municipality issue construction permits for the construction of the skiing facilities and infrastructure?

In the beginning of 2014 we ask MEW what measures will be taken against the construction of a number of ski facilities in Bansko Ski Zone, which has led to illegal logging and construction over 65% greater area in Pirin National Park than the allowed one in the concession contract.
MoEW uses prescription as an excuse.
Next we file in a request with MEW to apply Art. 156 of Nature Protection Act and Art. 122 of Biodiversity Act, which require the minister to stop construction being done in breach of environmental law, in order to ensure nature recovery and compliance with Park’s Master Plan and the Concession Contract. There has been no answer there since then.

Regional Prosecutor’s Office in Blagoevgrad refuses to prosecute violations in Bansko Ski Zone in Pirin National Park

With Ordinance from 09.12.2016, Regional Prosecutor’s Office Blagoevgrad recognizes most Bansko Ski Zone violations committed at the construction of Bansko Ski Zone, but refuses to prosecute them on account of prescription. It also refuses appeals against illegal construction licenses, which are without ecological licenses under the Environment Protection Act and the Protected Areas Act, despite the legal practice with the illegal licenses at Zlatna Perla in Strandzha Natural Park.
This is another proof that without a reform in the justice system nature protection in Bulgaria is doomed.

An appeal to European Parliament regarding Pirin Natura 2000 site

On 28.12.2017 the Council of Ministers of the Republic of Bulgaria approved amendments to the Management Plan of Pirin National Park, published as Decision 821/29.12.2017. With this Decision the CoM of Bulgaria neglects Habitats Directive 92/43/EEC, Birds Directive 2009/147/EC and SEA Directive 2001/42/ЕC and opens the gates for large-scale construction and felling of forests on the territory of 48 % of Pirin National Park.
The appealed is prepared so that every European citizen can use the text and send an e-mail to European Parliament deputies (contact list of all deputies).
This is important in order to raise awareness and support for Pirin National Park as Bulgarian authorities are putting it in danger!

DECISION № 821 from 29 December 2017 FOR AMENDMENT OF DECISION № 646 OF COUNCIL ОF MINISTERS FROM 2004 FOR ADOPTION OF THE MANAGEMENT PLAN FOR PIRIN NATIONAL PARK(STATE GAZETTE № 73 OF 2004)
This is a translation from Bulgarian to English of the decision to amend the current management plan of Pirin NP 2004 - 2013, which is still in force until the adoption of a new management plan.
Enclosed to the decision are two tables: table 31 - showing the management zones and the area from the park which they cover, and table 32 which shows the allowed/acceptable activities per management zone prior to the amendment.

DECISION No. 10238 Sofia, 27.07.2018 of the Supreme Admisnistrative Court against the decision of the Council of MInisters to amend the Management Plan of Pirin National Park 2004 - 2013
The court ruling confirms NGO concerns for violations of 3 Bulgarian laws. The ruling is being appealed before a higher instance of the court by the Council of Ministers.
