The National Ombudsman pointed out several irregularities for Bedechka before the discussion of the issue on 26 of September
According to the Ombudsman's statement under the provisions of Article 62, paragraph 3 in relation to paragraph. 2 from the Law on Spatial Planning, the change of purpose of the land in question is inadmissible. Konstantin Penchev enacted investigation on the case.
With this amendment and according to the development plan the few remaining green areas will be further reduced. This provoked officially lodged objection with 233 signatures of residents from around the park "Bedechka". The objection has been sent to the media. See Annex 2 (the document was sent without personal data, the number and addresses of signatories are duly recorded in the documents submitted to the municipality).
The objection, however, was not discussed. Another objection was also not taken into consideration, as well as the opinions expressed during the public hearing, held on 7th June. The minutes of the public hearing are not attached to the materials distributed to the councilors, which contradicts to the law.

This caused a dissent of the Ombudsman, who said: "The examination of these objections so far was thwarted. According to Konstantin Penchev, the position to divert the consideration of objections "can not be supported" and the motives of the municipal administration are "biased." The Ombudsman underlines that he follows with "particular attention the procedures for public discussion".
It is also noted that the municipality does not have an ordinance that regulates the way of taking into account the expressed opinions at public hearings. This in practice makes the public hearings meaningless.
In his letter, Mr. Penchev reminded that the municipality has failed to fulfill specific obligations to preserve the green spaces. Inter alia, it is noted that the amendment requires a written statement of the Minister of Youth and Sports. You can find all the irregularities in the full text
In recent months, the case "Bedechka" provoked public attention and protests against planned construction of nearly 400 acres of green space. In the plan for development of the park "Bedechka" are identified number of disturbing circumstances, some of which were noted in an earlier opinion of the Ombudsman Konstantin Penchev.
